Terms of use

1. Scope and provider

These terms apply to the use of the “Quizzies” app for iOS and Android, the website quizzies.de and all related services. The provider is Aplons GmbH, Alte Meeschen 98, 26169 Friesoythe, Germany (see legal notice).

2. The game

Quizzies is a party quiz for several people. The complete game – all rounds, finales, both game modes, teams and the question database – can be used free of charge and without ads, for free with up to 6 players per room.

We continuously develop Quizzies and may change features and content as long as the core of the game is preserved. We strive for uninterrupted operation but cannot guarantee constant availability, for example during maintenance or disruptions beyond our control.

3. Guests and accounts

You can play as a guest without signing up. You may voluntarily create an account (via Apple, Google or e-mail); accounts are available from the age of 16. Your details must be true and you must keep your access data secret. An account is personal and not transferable.

4. Quizzies Pro

Quizzies Pro is an optional paid subscription with additional features (for example up to 16 players, AI questions, your own question sets, all skins and frames, big-screen themes and sharing with two more people). There are two options:

• Pro weekly: €3.99 per week
• Pro yearly: €29.99 per year
• Free trial on the yearly plan: you can try the yearly plan free for 3 days. The trial is only available on the yearly plan (not on the weekly plan) and only once per Apple ID or Google account; the store decides whether you are eligible and shows it to you before purchase.
• Prices apply in Germany and include statutory VAT. In other countries the store shows you the applicable price before purchase.
• Pro is sold exclusively in the app via Apple’s App Store or Google Play. Nothing is sold on quizzies.de. The respective store processes the payment under its own terms.

5. Term, renewal and cancellation

Subscriptions renew automatically for the chosen term (one week or one year) unless you cancel at least 24 hours before the end of the current period. Your store account is charged within 24 hours before the new period begins.

If you started the yearly plan with a free trial, it automatically converts into the paid yearly subscription at the price shown after 3 days unless you cancel at least 24 hours before the trial ends. The yearly price is then charged to your store account at the end of the trial. If you cancel during the trial, Pro stays active until the trial ends and you are not charged.

You can cancel at any time in your store’s subscription settings: at Apple via https://apps.apple.com/account/subscriptions, at Google Play via https://play.google.com/store/account/subscriptions. After cancelling, Pro remains active until the end of the paid period. Deleting the app or your account does not cancel a subscription.

Refunds are governed by the rules of the respective store. Your statutory rights as a consumer remain unaffected.

6. What Pro unlocks

A Pro user who creates a room unlocks up to 16 seats, AI questions, custom sets and big-screen themes for that room. Skins, frames and emotes only apply to the Pro user themselves. When Pro ends, Pro items already saved on your character remain visible but cannot be selected again.

AI questions are subject to a quota (yearly: 30 generations per month, weekly: 7 per week). AI-generated questions may contain errors; they are labelled “AI” in the game and can be reported. Generic AI questions and AI holes may, after an automatic check, also be offered to all players (see the privacy policy, section 12); this can be switched off for every creation. Pro contains no in-game currency, no loot boxes and no purchasable points.

7. Sharing Pro

With your own active subscription you can share Pro free of charge with up to two other people (in the app under Profile → Pro → “Share Pro”). To do so, you send an invite link or code that is valid for 7 days. Anyone who uses Quizzies with an account or as a guest can accept the invitation.

Members get the Pro features described in section 6 as long as your subscription is active; they get AI questions with their own quota at half the size. If your subscription ends or is paused, Pro also ends for your members. A person can only be a member of one shared group; anyone with their own subscription uses that one.

You can remove members at any time, and members can leave at any time. A seat that becomes free can be given to someone else after 7 days. Sharing is free of charge; members do not enter into a purchase contract with us. Family Sharing of Apple and Google Play does not apply to Quizzies Pro.

8. Your content and rules of conduct

Display names, answers, bluff answers, team and crew names and your own questions come from you. You are responsible for them. For shared question sets you grant us the simple, free right to display them within Quizzies and to make them available to other players for as long as you share them.

In particular, the following is not allowed:

• Insults, threats, bullying and hate speech
• Discriminatory, violence-glorifying, pornographic or otherwise illegal content
• Personal data of others without their consent
• Content that infringes the rights of third parties, such as copyrights, trademarks or personality rights
• Spam, fraud attempts and exploiting bugs in the game

9. Moderation

We automatically check display names and free text with a word filter. Questions, player names and shared sets can be reported; creators can remove players from their room, and with an account you can block other players. We review reports, remove content that violates these rules and may suspend accounts temporarily or permanently in case of serious or repeated violations. There is deliberately no chat.

10. Adult content

The standard question database only contains content for everyone and from 16. Adult content (18+) is only available in AI sets and custom sets of accounts with a confirmed age of 18 or older, only after explicitly enabling it in the settings and only in rooms in which all players are enabled for it. Pornographic, violence-glorifying and illegal content remains prohibited there too.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In case of slight negligence we are only liable for breach of an essential contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely; in this case liability is limited to the foreseeable damage typical for the contract.

We do not guarantee the factual accuracy of quiz questions, in particular AI-generated and user-created questions.

12. Changes to these terms

We may change these terms if the app, the legal situation or the stores’ terms change. We will inform you of material changes in good time in the app. Changes to prices or terms of existing subscriptions only apply if you agree to them in the store.

13. Applicable law and dispute resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected. If the contracting party is a merchant, the place of jurisdiction is the registered office of Aplons GmbH.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Should any provision be invalid, the remaining provisions remain effective.
